By accessing or using TheMissingPeople.com (the “Platform”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you must not use the Platform.
2. Nature of the Platform
The Platform is a public information and publishing service that allows users to create, display, and promote listings related to missing or found persons.
The Platform:
- Does not verify content
- Does not validate identities
- Does not confirm case status
- Does not act as an intermediary
3. Eligibility
You may use the Platform only if:
- You are at least 18 years old, or
- You have legal authority to act on behalf of another person or organization
4. User Accounts
Some features may require account registration.
You are responsible for:
- Maintaining the confidentiality of your account
- All activity performed under your account
5. User-Generated Content
5.1 Ownership & Awareness License
You retain ownership of the content you submit (“User Content”). By submitting content, you grant Xeosol Norge AS a worldwide, non-exclusive, royalty-free license to use, reproduce, display, distribute, and share the content for public awareness purposes, including but not limited to:
- Awareness campaigns
- Social media publications
- Educational or informational materials
- Platform-related communications
This use is non-commercial in nature, does not transfer ownership, and does not permit commercial exploitation.
5.2 Responsibility & Consent
You confirm that all information submitted is accurate to the best of your knowledge and that you have the legal authority to publish it.
Legal requirements regarding consent, privacy, and publication of personal data may vary by jurisdiction. Where required by law, you confirm that you have obtained all necessary consents.
Xeosol Norge AS does not verify consent and relies solely on the submitter’s confirmation.
5.3 Prohibited Content
You must not submit content that:
- Is false, misleading, or defamatory
- Violates privacy or data-protection laws
- Encourages harassment, vigilantism, or violence
- Is discriminatory, hateful, or abusive
- Is submitted with malicious intent
6. Data Classification & Visibility
6.1 Public Case Data
Information submitted in a missing or found person report may be publicly visible, including (where provided):
- Name or aliases
- Gender
- Age or age range
- Religion or cultural identifiers
- Nationality or ethnic description
- Mental health or cognitive condition (where relevant)
- Physical description and photographs
- Last known or found location
- Date and circumstances of disappearance or discovery
- Public contact information
- Any other identification or awareness data
Public data is accessible worldwide and may be indexed or shared by third parties beyond the Platform’s control.
6.2 Non-Public Data
Any data not explicitly displayed as public is private by default, including:
- Account and login data
- Email addresses
- Internal identifiers
- Payment or billing data (if applicable)
- IP addresses, cookies, logs, and security data
- Internal moderation metadata
Non-public data is disclosed only where required by law or lawful authority.
6.3 No Hidden Case Data
The Platform does not maintain private investigative files beyond public listings and operational data.
6.4 Right to Account and Content Deletion
Users may request:
- Deletion of their user account
- Removal of submitted case listings
Due to public-interest considerations, removal of public case data may be restricted or delayed. Xeosol Norge AS cannot guarantee removal from third-party platforms once data is public.
7. Paid Services, Listings & Promotions
The Platform may offer paid digital services related solely to visibility and publishing.
Payment does not guarantee outcomes, recovery, verification, or legal priority.
8. Payments & Refunds
Refunds are governed by the Payments, Pricing, Refunds & Promotions Policy. Services are non-refundable once activated.
9. Automated Access & Scraping
Automated scraping or systematic extraction of content is prohibited without prior written consent.
10. Reporting & Moderation
Content may be reviewed, corrected, restricted, or removed at the Platform’s discretion.
11. No Guarantees & Limitation of Liability
The Platform is provided “as is”. Xeosol Norge AS is not liable for outcomes, losses, or damages arising from use of the Platform.
12. Suspension & Termination
Access may be suspended or terminated to protect platform integrity, compliance, or safety.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of Norway. Disputes shall be resolved by the courts of Norway, with Oslo District Court as the court of first instance.
